Somalia has enacted Law No. 6, the Somali Immigration Law. The law provides a unified framework for managing the entry, transit, exit, residence, and settlement of people in the Federal Republic of Somalia.
The Act was enacted to modernise immigration management, enhance national security, and align Somalia's practices with international standards. Its purpose is to give immigration authorities clear powers and to bring order to the movement of people across the country's borders.
Law No. 6, the Somali Immigration Law was enacted and entered into force on March 20, 2023.
Clear immigration rules are essential both for national security and for a country's relationship with the wider world. This law was designed to replace a patchwork of practices with a single, modern framework.
Article 2 (Purpose of the Law) defines its aim as regulating procedures for entry, transit, exit, and residence in Somalia. Article 5 (Objectives) sets out the goals of the immigration authorities, including protecting human rights, managing borders, and issuing permits.
Entry conditions are clearly set out. Article 11 (Border Points and Conditions for Entry) requires entry and exit at designated points, and Article 12 (Conditions for Approval of Entry and Residence) details the permits available, including tourist, transit, and study permits.
The law also addresses irregular status and documentation. Article 37 (Irregular Foreigner) defines when a foreigner may be treated as irregular and subject to deportation, and Article 42 (Travel Documents) lists the passports and documents recognised under Somali law.
This law is important because it gives Somalia a clear and modern system for managing immigration. Defined permits, border procedures, and rules of conduct for officers improve both security and fairness.
